The Securities and Exchange Commission, Thailand supervises securities and derivatives business under the Securities and Exchange Act and the Derivatives Act, licensing brokers, dealers, advisers and fund managers and publishing the list of firms entitled to serve Thai investors. Foreign-exchange dealing itself belongs to the Bank of Thailand under the exchange control regime, and the two mandates meet awkwardly.
The result is a gap rather than a rulebook: no domestic licence covers retail margin forex offered to the Thai public, so every broker advertising it locally is operating on a foreign licence. The SEC's answer is the Investor Alert list, a continuously updated register of unlicensed operators published alongside the licence check. Trading with an alerted firm is not itself an offence for the client, but it places the money, the account and any future dispute entirely outside Thai supervision and outside any Thai compensation arrangement.
